The recent decision by the Bombay High Court to dismiss a public interest litigation seeking a probe into the alleged disproportionate assets held by Shiv Sena (UBT) leader Uddhav Thackeray and his family has been a massive relief for Thackeray. The petition was brought by Dadar resident Gauri Bhide and her father Abhay, who raised questions about how the Thackeray family had accumulated enormous wealth without an official source of income.

The judges, Justice DS Thakur and Justice Valmiki Menezes, pronounced the verdict stating that the petition lacked any evidence on the basis of which a prima facie case could be made out for a probe by the Central Bureau of Investigation or any other agency. Moreover, the judges also stated that the Bhides’ attempt was to seek a “roving probe” that was monitored by the HC “based on nothing but bald allegations”. The judges termed this an “abuse of the process of law” and directed the Bhides to pay Rs. 25,000 as cost to be deposited in the Advocates Welfare Fund within two months.

During the hearing on December 8, 2022, Bhide had argued that after her complaint to the police commissioner was forwarded to the Economic Offences Wing, no action was taken. Public prosecutor Aruna Pai had said that the EOW had already initiated a preliminary inquiry. Senior advocate Aspi Chinoy, along with advocate Joel Carlos, who was representing Uddhav and his son Aditya, countered that Bhide’s petition had no material facts to make out a case. They stated that there was nothing in Bhide’s petition to invoke the HC’s extraordinary jurisdiction to direct investigation by central agencies.

The decision by the High Court to dismiss the petition is a victory for Thackeray and his family, who have been plagued by allegations of disproportionate assets. The judgment sends a clear message that allegations of corruption cannot be based on mere speculation or bald allegations but must be supported by concrete evidence. This has been a much-needed breath of fresh air in a political climate where unfounded allegations and mistrust often reign supreme.
